Montgomery Building Owners Get Extension to Pay Taxes

The Town of Windsor Locks had a foreclosure sale scheduled for February 19 before a judge granted the extension to September.

The owners of the empty Montgomery mill complex at the corner of the northeast corner of Routes 159 and 140 in Windsor Locks have been granted an extension by a Superior Court judge to become current on their taxes.

The Town of Windsor Locks is pursuing a tax foreclosure action against the owners of the Montgomery mill complex.  In addition to owing back taxes, the owners, Canal Benk Realty LLC, owe the town for costs related to two separate fires at the property.  A tax foreclosure sale had been scheduled for February 19 until the extension was granted, officials said.

First Selectman Steven N. Wawruck Jr. said the judge indicated that this will be the only extension that will be granted.

Wawruck said Tuesday he’s not disappointed in the decision and is just letting the process play itself out in the courts. The town was approached by the owners and their attorneys about being allowed more time to make the payments, he said.

Wawruck said the town is in a good position, the economy is improving and there appears to be developers out there who would like the property.

“We’re still optimistic the auction will take place,” Wawruck said.

The town will continue to market the property to potential developers, Patrick McMahon, the town’s economic consultant said.  The property is currently a featured property on the CT Sitefinder , which is the most comprehensive database for available land and buildings in the state and which real estate brokers rely on for information.

An appraisal secured by the town valued the property at $900,000.  A court order appraisal valued the property at $1 million.  Town officials said it appears there is enough equity in the property to cover the owners outstanding liabilities to Windsor Locks.

 The property includes three contigous parcels of approximately 3.38 acre of residential- zoned land with two buildings plus a detached garage comprising about 255,446 square feet of mill structure.
